Dismissal from Programs. A student may be dismissed from a program for academic reasons which may include but is not limited to grades, professionalism, or failure to remain in academic good standing as defined by a program, or based upon failure to comply with other specific program requirements. Failure to comport with professional and/or ethical standards applicable to a particular discipline or program may be grounds for dismissal. Program includes but is not limited to all undergraduate and graduate programs. The program dismissal procedures established in this chapter are applicable to dismissal of students from a program for academic reasons. The program dismissal procedures established in this chapter are not applicable to expulsion from an institution. Except as otherwise provided in this chapter, the System institutions and professional schools may establish written policies, procedures and sanctions for program dismissals for academic reasons that may be used in lieu of the procedures of this chapter, subject to prior review by the institutions general counsel and to the approval of the president of the institution. In the absence of such an approved policy, the following will apply. Section 2. Dismissal Procedures. a. Notice of the Dismissal. The student must be provided with a written statement of reasons for the program dismissal action before the student is dismissed from the program. However, student behavior or actions that threaten professional and/or ethical standards or norms may result in a modification of this procedure. Implication of risk to life, health and safety, or other special circumstances resulting in program disruption may be a basis for removal from program activities (including but not limited to academic classes) pending the outcome of a review conference. Approval by the institutions president is required in cases of summary dismissal where a notice of dismissal and review conference occur after the program dismissal is effectuated. The notice of dismissal must include information about the review conference (set for the below) and the date for the review conference. b. Review Conference. The student must be afforded the opportunity for a review conference. A review officer will administer and carry out the review conference. The review officer must be at the administrative level of Dean or Academic Vice President. The review conference is an informal conference that is not intended to be adversarial in nature. The student may be accompanied by an advisor during the informal conference. The advisor serves as a supporter and advisor solely to the student during the review conference. In this process the advisor has no right to speak during the review conference except to the charged student. If a student, with notice, does not appear for the review conference, the review conference will still proceed. The review conference is the time for presentation of the information /documents or witnesses in support of the dismissal. The review conference is the time at which the student is afforded the opportunity to present information/documents or witnesses on his or her behalf. Witnesses may present a statement to the review officer. However, only the review officer may ask questions of any witnesses. Further, the faculty member who makes the recommendation for program dismissal has the opportunity to participate in the review conference and may present information/documents or witnesses in support of the program dismissal recommendation. A review conference must occur no earlier than three (3) college working days following written notification to the student of the recommendation for dismissal. However, upon request by the student the review officer may consider and decide a students request for an extension of time with regard to the review conference. The student must be informed of the above review process in the written notice of dismissal set forth in (a) above. c. Review Officer. The review officer must be an individual at the level of Dean or Academic Vice President. The review officer must not have been involved in the program dismissal recommendation. The review officer may include a representative from the applicable discipline/program in the review conference. d. Written Decision. After careful review of all the evidence and relevant circumstances, the review officer must issue a written decision setting forth the reasons upon which the final decision is based. If the review officer does not uphold the recommendation for dismissal, the student must be reinstated in the program. The review officer will render a decision to the student and the program within three (3) college working days of the review conference. e. Standard of Review. The review officers determination shall be made on the basis of whether or not it is more likely than not that the student engaged in behavior or engaged in actions warranting program dismissal. f. Decision Final. The decision of the review officer is final and is not subject to appeal. g. Re-Entry or Re-Admission Each institution shall determine the conditions, if any, for re-entry or re-admission to the program. h. Grade Appeal Process: A student must utilize the institutions grade appeal process in connection with any grade challenge. The institutions grade appeal process is the sole avenue appealing the issuance of a grade. This section does not afford a second opportunity to pursue a grade appeal.
